The Tripartite agreement lists the obligations of all the three parties involved. This agreement contains all the details of the mortgage for the home\/apartment, the rights &amp; liabilities of all the parties involve specifications of the property, the carpet area and all details pertaining to the loan\/financing of the property, the date of possession of the property and specifies the details of the penalty clause.<br \/>\nTripartite agreements have been established to assist buyers with acquiring loans for properties against the planned purchase of the property. Since the home\/apartment is still not in the name of the customer until possession, the builder is included within the agreement with the bank.<\/p>\n<p>The following details are required in a Tripartite Agreement.<br \/>\n\u2022 The Parties to the Agreement<br \/>\n\u2022 The Objective of the Agreement<br \/>\n\u2022 Rights and Remedies of the Parties<br \/>\n\u2022 Legal mechanics<br \/>\n\u2022 The Borrower&#8217;s Perspective<br \/>\n\u2022 The Developer\u2019s Perspective<br \/>\n\u2022 Bank\/Lender\u2019s Perspectives<br \/>\n\u2022 Selling Price as agreed<br \/>\n\u2022 Date of Possession of the property<br \/>\n\u2022 Stages and the progress details of the construction<br \/>\n\u2022 Interest rate as applicable<br \/>\n\u2022 EMI (Equal Monthly Installment) details i.e. the installment payment cycle<br \/>\n\u2022 Common area amenities as agreed by the developer<br \/>\n\u2022 Penalty as payable if the booking is cancelled<\/p>\n<p>The Tripartite Agreement should have a declaration \/ representation from the developer or the seller stating that the property has a clear title and that the Developer has not entered into any new agreement for the sale property with any other party.
